Amit Shah May Present 3 Criminal Laws Bills
The Centre will introduce new criminal legislation bills amid the Parliament’s Winter Session in response to several suggestions from a parliamentary panel. On Tuesday, the three revised legislation will be presented before Parliament. Bharatiya Nyaya Sanhita Bill, Bharatiya Nagarik Suraksha Sanhita Bill, and Bharatiya Sakshya Adhiniyam Bill aim to substitute the Indian Evidence Act, 1872, the Indian Penal Code, 1860, and the Code of Criminal Procedure Act, 1898, in that order. The Centre approved the submission of proposals to alter the criminal code to replace the pre-colonial laws this week. On two issues regarding adultery and homosexuality, the Parliamentary Standing Committee and the Cabinet were said to be at odds.
The Committee’s suggestions to reinstate adultery laws were rejected by the Cabinet, and Section 377 of the IPC was not reinstated or kept in place. Three statutes from the British era are being repealed and replaced by the new measures, which were submitted in Parliament on August 11 during the Monsoon Session. Afterwards, on August 18, the legislation was sent to the Parliamentary Standing Committee on Home Affairs, which is affiliated with the department, for review. The group met with representatives from the Ministry of Law and Justice, the Ministry of Home Affairs, subject matter experts, and other interested parties on many occasions, according to Union Home Minister Amit Shah. On November 10, the committee sent in its reports and recommendations.
“Amendments to the Bharatiya Nyaya Sanhita Bill, 2023 are suggested in response to the committee’s suggestions. He informed the Parliament that a new bill is being submitted to replace the Bharatiya Nyaya Sanhita Bill, 2023. Regarding the Bharatiya Sakshya Adhiniyam and the Bharatiya Nagarik Suraksha Sanhita, two identical withdrawal statements were also made. Shah urged the Chair to refer the proposals to the standing committee for a lengthy debate shortly after they were tabled in the Lok Sabha on August 11.
